Of course destroying the emails is a felony in itself. What they ascertain was that Hillary regularly violated the law by using her personal email to send and receive classified information. The conclusion is that Hillary and many around her of criminal conduct. The question is where would you take this indictment since it would become political? Another question is would it be worth it? Any penalty would be blamed on partisanship. What judge would want that?

No, we can only know that Hillary acted criminally whether from intent or incompetence.
