The Constitution does specify that it's the Senate's business to confirm, but it does not specify every nominee has to be entertained. Meanwhile, Senate rules DO say that information such as that held by Feinstein will be introduced BCD, discussed, investigated and communicated to the nominee giving that person an honorable way to back out, if prudent to do so, without being smeared publicly by the press.
