If you are going to get arrested, smash your phone on the ground...

The question should be, what gives the government the right to invade your right to privacy without a valid search warrant. Your phone being your personal property and as such an extension of your person should not be subject to a search without probable cause and a valid warrant. Just having a phone in your possession shoud not be cause even if you are arrested unless there is reasonable proof that you used your phone in the particular crime for which you were arrtested.

The fucking constitution grants no specific right to privacy, btw.

Fourth Amendment protects against illegal search and seizure. But...

The Supreme Court is going to review a couple of cases where the police searched the phone of some one they were arresting and found evidence:

But I doubt very much that they will completely eliminate the ability of cops to look at what is on your phone. In fact, they might not change the law at all.

The Constitution was written to establish a form and function of government and to establish limitation on the government, not to control the rights of the people. The so called Bill of Rights that is the first through the tenth amendments are not granting rights but limiting the control of government over the people. The people retain all rights including the right to privacy.

So if, as you believe, the Constitution grants rights, where is the one that grants the right to not be offended.

You could just put a screen lock code on your phone and refuse to reveal it to them. My guess is they are going to have to at least charge you with a crime and get a warrant to search the phone before they attempt to break the code.

What is and is not on the phone varies from phone, providers and how the phone is set up.

There's software to not just lock out the phone but to encrypt the data on the phone. The software and I'm not talking the std software from the cell phone, is very sophisticated.

I don't know about your phone exNYer but they can ID my phone by the numbers on the label behind the battery. The only way I'm going to be able to destroy it is by tossing it in a very hot fire - literally a burner. Even sticking it in the Microwave oven may not damage the sim card enough.

What I'm talking about is if the cops stop you for say soliciting (male POV). Make it difficult for them. I'd like to know how many regular johns who had their phone taken actually had a warrant issued by the police to break into the phone. For a female, same thing.
