Yea I was going to say something else happened there for him to get state jail because you still do county for a second DWI. Maybe he can request a 1244(a). That allows him to do his state jail time in the county and cut his sentence in half. Otherwise he's in there day for day.

Actually, it is reasonably easy to remain "out of jail" ..
