Ok so I have a question. Maybe Im just being naive but what if there is somebody that really does not like you and threatens to out you to LE or other outlets. Even with the ads they post and the reviews if LE does attempt a sting only to fail because you keep your mouth shout and dont give them the hard evidence they need you cant be charged based on the hearsay, ads and reviews can you? If they can not prove you comitted a crime then how are they to know a crime was actually commited. RIGHT? Maybe this is a stupid question but a friend of mine said they could arrest you. I think it's unlikely you'll get arrested unless you actually meet with a vice cop. They sometimes WILL lie about what happened. Or say, "she didn't actually say she would perform sex for money, but she made it clear by her actions." There have been convictions in such cases. You're certainly less likely to get busted if you don't say anything stupid.

They could find the guy who wrote the reviews and get him to testify that you engaged in prostitution. In theory, they could get a conviction. I think that's pretty rare. They could introduce your ads into evidence. They could produce reviews as evidence. If you want to keep these things from being used against you in court, you'd need a lawyer to fight for you. I wouldn't count on succeeding in suppressing that evidence.

They're often not necessarily after a conviction. They are often looking for a plea bargain. Failing that, they'd like a conviction, but they may settle for simply costing you dollars, jail time, embarrassment, and inconvenience before they drop the charges. Good luck winning a lawsuit for malicious prosecution, false arrest, etc.

If they take you to trial, you lose even if you win. You may not spend any more time in jail, but you are still out lots of money, time, and other hassles.

That doesn't say those things will happen. It's just that you should not expect justice without a lot of money and hassles on your part. Maybe not even then.

Yeah, it is possible to be in the wrong place at the wrong time, or do something stupid in public, or to piss off some local cop and get arrested just because he wants to hassle you. But cops have to answer to chiefs and prosecutors have to answer to DA's, and arrests without a chance of conviction wastes their time and money, too.

It's legal IF the judge or jury believes that what is done (or intended) behind closed doors is not part of the fee.

A provider has to first put herself in the position of being arrested which can't happen unless LE can locate the provider and arrest her for something. That can't happen unless a provider agrees to meet with someone who responds to what she posts. As Chevalier noted, it's up to the the judge or jury to decide what is and isn't legal, so the best defense is for a provider to be careful about who she agrees to meet and avoid getting arrested in the first place.

Once she gets arrested, I'm not sure it makes a lot of difference how the trial goes. In most cases, there will be a record of the arrest and court records, so what happens after being arrested is most likely going to be between ``winning'' in court and just pleading guilty and paying the fine. In that case, it's the cost of an attorney, time and probably paying the fine vs. just paying the fine.
