The secret of executive privilege is that Congress does not get to decided who, what, or when it exists. That is up to the courts. This is a case where the congress is out over its skis by claiming Bannon is wrong. A decent judge would have told them that. For all the bluster and pomp he put out before the trial, he sure as hell went out with a big wimper of silence. Kinda brought back memories of the dozens and dozens of cases thrown out of court for lack of proof about election fraud. (Why didn't they even mention fraud in the court room when they were screaming it everywhere else?)

Regardless of legal point on executive privilege, as long as it doesn't involve national secrets, *I* would say the person that has executive privilege granting rights, current POTUS, can have a call on it.
