Nationwide red flag laws

Really? While hate groups and anti govt groups have seen a huge resurgence going literally unchecked?
What do most mass shootings and like crimes have in common? The perps were engaged in online sites being heavily influenced and posting about what they were going to do or had distinct warning signs to trigger these red flag laws. When you spend all of your time spouting this garbage, it should be no surprise when some weak minded individual feels they need to act. It should also come as no surprise that no one believes what you say anymore. You could call it the Boy who cried wolf syndrome.

I am unaware of any recent attacks on leftists. But there are many stories of leftists attacking people wearing red hats. There are even two assassination attempts against Trump. Before you make the claim that they were registered GOP voters, I remember left leaders encouraging Dems to register GOP so they could impact GOP primaries and get the most extreme GOP candidates.

The comments in this thread just illustrate why these laws are such a bad idea. The creation of the thought police is a recipe for disaster and will be used by all sides in abusive ways.

Red Flag laws should be based upon mental health rather than political ideology.

And these laws can have in intended consequences. Suppose your girlfriend's mother . . . who perhaps does not like you just because . . . decides to tell a tail to the authorities? You may not even own a gun, but there will now be, at minimum, a police report. There could be a warrant supported search (sur-PRISE!) of your stuff anyway. Do you have anything bedsides a non-existent gun THAT you want kept on the down-low?


Another scenario:

Lets say that you do own a firearm, legally possessed in every way consistent with the laws of the jurisdiction where you live. Your mother-in-law decides that you are indeed the bad person she warned her daughter about and calls the police. They act in accordance with the Red Flag law in effect there and you surrender your gun(s).

The authorities have seized your property without a finding of wrongdoing. You have not been charged or tried for any crime, yet your stuff is gone. In some jurisdictions firearms are never returned regardless of the circumstances (as in you are found to not be guilty of anything).

Many feel that this is a violation of the Fourth Amendment.

These laws are not biased towards any group. Apply them equally of course.

And yes there should be a built in appeal if erroneously charged.
Red flag laws resemble that of protective/restraining orders.
Where you lose your gun rights for a period. Take counciling then revisit with the court to reevaluate.
A lot of the same process and criteria for tpo's and tro's are used.

Why is it the ones who scream and shout for red flag laws are the same ones pounding the RTM button into oblivion?

I'm all for Red Flag laws with the following caveat: If you falsely accuse someone or your claim against someone isn't substantiated, you should face criminal and civil charges by the person you wronged. This should include law enforcement and judges.

Jan 6 comes to mind. Red flag laws when enforced can stop some of this mess. No laws are perfect
No laws will stop crimes a hunert percent. These laws are based on mental issues and resolving them peacefully. Isn't that the point.
