this is one of the reasons people voted for Trump over Clinton. as my dad railed about for many years, judges have long been "legislating from the bench" which is not their purview. they interpret existing law and doctrine, they do NOT re-write it. i'm sure posters here are familiar with the 9th circuit court of appeals? the most liberal and overruled circuit court.
it's not just the Supreme Court that was a concern against Clinton for packing with uber liberals it's also the circuit and federal courts. while judges should not legislate from the bench to begin with, if they are going to, i'd prefer they did so from a
conservative point of view.
in this way one of Trump's legacies will be the federal judiciary for decades to come.
