I'm not Yssup, but I think she was spot on. Obama is stuck with Guantanamo by the Congress (but Dems and Repubs, but mainly Repubs who kicked up the most dust sensing political advantage - some Dems went along sensing political vulnerability) and with about 130 detainees that they cannot return to their countries and cannot put through military commissions or any sort of trial anywhere. It remains to be seen whether they can put the three dozen or so through any sort of legal process that allows us to resolve their situation one way or another. It doesn't even look like they have a slam dunk with KSM who is likely the easiest case of all if there is any easy case to try and convict any of the 162 left in Guantanamo.
I think Obama did a terrible job on this speech as well as on the policy around Guantanamo, but he is boxed in and so far hasn't found a way to unravel the Gordian knot of those detained and not charged or tried to deliver on his campaign promise (Congress specifically denied that any funds could be used to move the detainees to the US which is where they would have to go to be tried in our courts, detained in our prisons or transferred anywhere else in the world pretty much so they are stuck there).
