Mitch's line was "he didn't get away with anything, Yet. Meaning it remains to be seen if he will and emphasizing the same thing I tried to emphasize when I criticized House Managers who kept saying that if they didn't do this impeachment, he wouldn't be held "accountable", he would "get away with it", suggesting there was nothing else that could be done if they didn't do this. Whether they knew they weren't telling the truth when they said that or they said that to make the impeachment sound more "necessary", I guess we'll never know but considering all the other "mis-representations" and leaving out exculpatory evidence that would never have been permitted in a court of law, my money would be on, they knew they weren't telling the truth but did it anyway like they did for 4 years.

I agree. A judge would have had a field day with their "evidence", 99% of which didn't speak to what is required to prove the charge using the Brandenburg test, finding the words in that Jan. 6th speech that incited violence because nothing he said or did before that speech would be relevant. But the defense also would never be allowed ( I would think ) to put into evidence, anything Democrats said or did because it wouldn't be relevant to the charge against the defendant.


I think the biggest problem for the prosecution, would be that they would have to present the entire speech Trump gave on the 6th, not edit it like the House Managers did, and point to the words that they claim incited the violence and the problem is those pesky 4 words Trump said "demonstrate peacefully and patriotically". I can't think of anything that would speak to reasonable doubt more than that and that he didn't intend for the crowd to use violence, only their voices.

They didn't have a winnable had, that's the point. They knew they didn't have 67 Senators and weren't likely to get 67. That is not going in with a winnable hand.


As much as the MSM likes to talk about the "biased" Republicans, there were 50 Democrat votes to convict before any evidence was presented. Hell, a few of those Democrat Senators wanted Trump impeached the day he was elected 4 years ago.


In a court of law, after "voir dire", there would only be a handful of jurors left, maybe. "Senator ( pick a Democrat ) did you at any time voice an opinion prior to this trial, that you thought the defendant was guilty of an impeachable offense"? Remove for cause your Honor.


The only thing Democrats had was emotional hatred of Trump and that wasn't enough.
