There are 1+ million people with HIV in the US. If you could sue someone you had sex with because they had HIV, the courts would be flooded.
If you don't have HIV, you have no harm, therefore no damages to support a case. You can't claim retroactive mental anguish NOW for sex that happened 2 years ago. Again, if that was possible, the courts would be flooded. Just because you panicked when you learned that a former lover has HIV, it doesn't give you damages. Get tested and if you don't have HIV, then you don't have a case.
Even is you do have HIV, you have to prove you got it from your former partner and not the OTHER WAY AROUND.
And, if it unclear who gave it to who, but you wore protection, then it gets even more difficult to win the case.
And then there is the issue of consent, which will become a he-said, she-said spat right away. Sheen says that he informed the porn star that he had HIV, and she consented because they always wore condoms. Then what?
