Qualified immunity goes to the individual liability of state actors. I was talking about tort liability of the state under the doctrine of respondeat superior fir the actions of their employee. That immunity is usually under a remnant of sovereign immunity. I agree that qualified immunity is a horrible doctrine, by the way.
