But in the case of Mr. Lumens; the news story says he shot the fleeing robber.....how is that shooting to stop the attack? The attack was over, yet it looks like Mr. Lumens won't face a grand jury....and if someone is shooting a fleeing attacker, doesn't that shooter risk shooting him in the back, and creating even more legal exposure for the shooter ? judging from the many posts I've read on ECCIE regarding crime and.. let's call it the second amendment.. we (myself included) appear to be strong supporters of, let's call it "gun rights", and more stringent crime-control measures.. as opposed to other political/social topics, where there is often strong disagreement among us..

if my observation if right, what does that imply? anything? is it a function of where we live, age, sex? our chosen hobby?

Back in 2007 I believe, lawmakers in Texas re-wrote the deadly force laws. In order to allow citizens, to use deadly force to protect both themselves and their property. Rest assured, the family of the assailant will sue the elderly man for shooting the bastard. Even after he had committed a Felony offense. But IMHO, guys don't just wake up one day and decide to commit aggravated robbery. He most likely had committed acts of violence before.....and would do so again had he not been shot. My biggest concern in hearing about this, is that apparently the gentleman wasn't comfortable with his weapon. And because of the mans lack of competence with his weapon, innocent folks might have been injured as well.
