1) Very true. I cannot find it with text or codified searches. Further, there are no cross-references to an appropriate statute. After 10 minutes of looking, given this thread is rhetoric for me, I gave up looking. I was forced to assume that the legislature failed to define it.

2) Indeed arguing against the presumption of constitutionality may be possible and persuasive, but that's an expensive uphill battle if I've ever seen one. I would never suggest to do this lightly. Nevertheless, good point.

I seem to recall reading about the law in Michigan or another state (Oklahoma, maybe?) where, after it'd been on the books forever. someone challenged the law because it didn't define "prostitution."
IMO, I feel it would have to be more to it to argue the difference. When you look at these SB/SD sites, they have restrictions on pictures and wording that it would be hard to say your promoting prostitution. Then look at these escort sites, they are more detailed about hourly rate and nearly naked or nude pics.

As far as business wise, a SD has more of a connection then just the sex. It's like we are dating on the down low.

But LE works with a budget and if targeting prostitution wil most likely spend their time on the transactions that occur between true hookers and johns. After all.... The average hooker will have dozens of clients a month and that can yield additional busts..... A SB will typically only have one or two guys.....

Now if they want some media attention the whole SB/SD lifestyle has been racking national exposure... It would be very easy for LE to sting guys on some of the Sb websites... There is a laxness among many of the "john types"....

FYI- many, if not most, anti-human trafficking organizations make a clear differentiation between the acts of consenting adults and coerced sex acts. Many advocate for the decriminalization of prostitution to push it out of the shadows and alleviate the market for sex trafficking.

A) Escort is on the clock, the SB is not.
B) For an escort you need an acronym dictionary (DFK, LFK, etc..) a real SB does even know about this.
C) decent escort can provide "OK" experience on first meet, SB probably will not. In fact a careful SD does not even ask for sex on first meet.
D) A quality escort is like a fine time-share condo, an SB is a like your weekend cabin. (You are more involved with the well-being of your cabin.)
E) Developing a fine SB story requires a lot of time.
