Yes-- it is up to the courts to decide.. but there's another aspect.


Unless you have a chucklefuck dumb enough to either admit they wanted to sway the judge-- or they have a sign to that effect... any decent lawyer can get that tossed out of court. THEN-- the person is likely to sue for having their 1A rights violated.



Its a massive expense all along the line..


Now-- as soon as those protestors breach either the SCOTUS or someones personal home-- arrest every last one of em. Fair is fair.

There is only one sign out of the bunch that could get a conviction.. the "Don't like me at your house" one.


The rest-- a decent lawyer could get tossed out without much of a problem.


As I said before-- you and I might know full well their intent-- but it has to be proven in court and 1A makes that a very delicate minefield.
