Eric Holder’s senior communications aide acccidently called House oversight committee chairman Darrell Issa’s staff and asked for their help spinning new revelations about the IRS scandal, Issa said in a September 8 letter to Holder. According to Breitbart, the idiot Holder hack is Brian Fallon and was once a senior aide to corruptocrat Chucky Schumer. Not a smidgen of corruption, right Barry?

According to the letter, Fallon – who is not named in the letter but confirmed he made the call – asked if the aides could release the IRS scandal documents to “selected reporters” to give Fallon an “opportunity to comment publicly on it.”

Fallon explained to Issa aides that the Justice Department’s Office of Legislative Affairs had not permitted him to release the documents to the public and he wanted to get ahead of the story “before the Majority” – meaning Issa – could share it, according to the letter.

Issa aides – who had placed the call on speakerphone – were “caught off guard by the unusual nature of the call and the odd request” and asked Fallon to “e-mail the material for evaluation.”

“At this point,” Fallon “abruptly placed the call on hold for approximately three minutes.” When Fallon returned to the call, “he was audibly shaken. He immediately stated that there was a ‘change in plans’ and that there would be no effort” by DOJ to release the material early.

Fallon “proceeded to pitch the idea that the Department and the Committee should ‘help one another’ while simultaneously saying that ‘you need to say what you need to say.’”

In the letter, Issa told Holder the phone call suggests ongoing coordination between DOJ aides and Cummings’ staff to undermine oversight committee investigations.

Fallon’s “efforts to prejudice the Committee’s oversight work demands examination,” Issa wrote.

Fallon, however, said in a written statement that nothing untoward occurred.
“There is nothing inappropriate about department staff having conversations with both the majority and minority staff as they prepare responses to formal inquiries. That includes conversations between the spokespeople for the Department and the committee,” Fallon said.

The left’s response to the IRS targeting scandal has morphed over time as more information has come to light. Mostly gone are the truthers who think nothing unethical happened or that this is an aimless witch hunt. It’s now clear to any sentient person that the IRS was indeed engaged in this targeting scheme ahead of a presidential election. Additionally, as I wrote last week, it’s since been revealed that the IRS began destroying evidence once the investigation into the targeting began.

That particular destruction of evidence concerned Lois Lerner, the former official at the center of the scandal, in order to get rid of her email correspondence. The media yawned at the revelation of the destruction of evidence, apparently tiring of this story. So the same day of Fallon’s phone call to Issa’s staff, the IRS admitted it lost the email of “five more workers who figure in the investigation into the alleged targeting of conservative nonprofit groups,” as the Wall Street Journal reported.

The Democratic response to the investigation has thus gone from the eminently silly denial that anything untoward took place to actively trying to thwart the investigation and run interference for the IRS–which, in its targeting scheme, was only following the pronouncements of high-level congressional Democrats, after all. And those Democrats have gotten quite uncomfortable with the investigation. Democratic Sen. Carl Levin has put together a report attacking the inspector general conducting the investigation.

Such interference and/or stonewalling wouldn’t be out of character for this DOJ. As the Washington Examiner reported yesterday, according to the department’s inspector general “Department of Justice senior officials have barred or delayed the inspector general there from gaining access to documents crucial to high-visibility investigations.”

The “nothing to see here” brigade has lost any semblance of credibility. In response, they’d like to make sure there’s actually nothing to see by the time investigators come looking for it.

In a February 2011 email, The Hill reports, Lerner insisted that Kindell be in the loop on Tea Party cases, saying they were "very dangerous."

Another experiencing the hard drive crash epidemic was Nikole Flax, who was chief of staff to interim IRS chief Steven Miller, who was forced out as the Tea Party scandal broke. Both the targeting and the cover-up were fully covered by Breitbart News, which frequently exposed Odumbo administration lies.

Less than a week later comes news of the Breitbart audit, suggesting that the administration and its political arm, the IRS, have learned nothing, and that what Odumbo said amounted to not even a smidgen of corruption has become an overwhelming stench.

"The Odumbo administration's timing on this is exquisite, but try as they might through various methods to silence us, we will only be emboldened," Stephen K. Bannon, executive chairman of the Breitbart News Network, said in a statement.

The IRS released its own statement saying there is nothing to see here and we should just move on given that the agency audits tens of thousands of businesses every year, presumably even manufacturers of computer hard drives.

"Audits are handled by career, non-partisan civil servants and the IRS has safeguards in place regarding the exam process," the IRS claims, with a straight face.

Sen. Ted Cruz, R-Texas, doesn't buy it, saying, in a bit of an understatement, that "given the IRS' disturbing track record of illegally targeting conservative organizations ... the decision to audit Breitbart News Network, LLC appears highly questionable."

Justice Dept. official offers conditional leak of IRS documents, to House GOP staffers.

The staff of the House Oversight Committee’s Republican majority received a curious phone call two Fridays ago from Brian Fallon, director of the Justice Department’s office of public affairs.

Mr. Fallon confided that he had certain documents pertaining to the Internal Revenue Service scandal, which had been requested by Oversight Committee Chairman Darrell Issa.

He asked that staff leak the documents to “selected reporters” – affording Attorney General Eric Holder’s spokesman an opportunity to publicly downplay their significance – before he handed them over to Rep. Issa.

It was an artful plan by Mr. Fallon, which he almost certainly would have pulled off but for one slip up: He called Rep. Issa’s staff when he meant instead to call staff for Rep. Elijah Cummings, the committee’s ranking Democratic member.

Mr. Fallon’s phone call confirmed suspicions that Rep. Cummings has been running interference for the Justice Department.

It also suggests to us that the President Odumbo's attorney general is less interested in getting to the bottom of the IRS scandal – in which conservative groups were targeted for special scrutiny when applying for tax-exempt status routinely conferred to liberal groups – than he is in containing the episode’s political fallout.

The documents that prompted Mr. Fallon’s misdialed phone call concerned former Justice Department lawyer Andrew Strelka, who previously worked for Lois Lerner, who headed the scandalized IRS office that placed conservative groups on the agency’s “Be on the Lookout List.”

One of those groups was Z Street, a Philadelphia-based pro-Israel organization, which was informed by Ms. Lerner’s shop that it was targeted for special scrutiny because its views “contradict those of the Odumbo administration,” Z Street founder Lori Lowenthal charges.

Ms. Lowenthal’s group filed a lawsuit in 2010 against the IRS – Z Street v. Koskinen. And of all the attorneys the Justice Department could have assigned to represent the IRS in the suit, Mr. Strelka was one of those chosen.

Mr. Issa’s committee is understandably interested in speaking to Mr. Strelka, who worked directly for Ms. Lerner, and whose participation on the Justice Department’s defense team in Z Street constituted an obvious conflict of interest.

But Mr. Strelka has been nowhere to be found. The Justice Department told Oversight Committee staff – the same staff Mr. Fallon mistakenly phoned – that Mr. Strelka is no longer on the payroll. But Justice has not provided contact information for its former counsel of record in the Z Street suit.

That’s the kind of ducking and dodging – in legal parlance, a better term would be “obstruction of justice” – that has marked the Justice Department’s investigation of the IRS scandal since Mr. Holder announced it 15 months ago.

Indeed, about the only things we know at this point is that Mr. Holder decided more than six months ago that no one would face criminal charges stemming from the IRS scandal – not even Ms. Lerner. And that the attorney general sees no need to turn over the investigation to an independent counsel.

Well, we take issue with Mr. Holder on both counts.

We think the suspicious loss of Ms. Lerner’s emails, as well as the destruction of her BlackBerry after a congressional investigation was launched, could very well be evidence of a criminal cover-up.

We also think that the Justice Department investigation of the IRS scandal is so compromised – as evidenced by Mr. Fallen’s unwtting phone call – that Mr. Holder needs to turn it over to an independent counsel.
