What happens when the first Texas Felony case gets dismissed? That is coming, just a matter of time. I think LE knows it, so the Felony Law is an upfront deterrence gambit. I haven't heard of a single Felony conviction yet. Of course, guys may have taken pleas, and not tested the Law to its fullest.

Even if cases are dismissed, the monger &/or provider still suffers legal fees. And that has enough impact to make you think twice about where you go and what you discuss. Thinking with the big head is required before letting the little head take over.

As far as felony convictions under the solicitation statute, remember that the law specifically provided for a probated sentence for first time offenders, so there is ample incentive for most of those getting arrested to take advantage of that option and not fight the charge.
