I'm certain I speak for most of the investors, though not the activists who are essentially fake shareholders, buying a few shares to try to appear like an aggrieved investor.
XOM makes up part of the DJIA. It is one of the most commonly owned stocks, whether you do so directly or through some kind of fund. There are plenty of people who own stock in XOM who would disagree with you.
But, you are missing the point. It isn't a crime only if people lose money. You are arguing that the ends justify the means, rather than the intent makes the crime. If the intended to defraud people, whether it worked out in their favor or not, that is the crime. And the AG doesn't have to wait around until the price goes down before they can prosecute intent. If it is there, of course.
