Koskinen admitted at a House Oversight and Government Reform subcommittee hearing when asked if any computers had recently crashed under his watch.

Koskinen admitted that destroying records would be an act “not consistent with the law,” but maintained that there’s no evidence that the IRS intentionally destroyed records.

“Ms. Lerner’s Blackberry was replaced in February 2012 as part of an ongoing Blackberry update….it was disposed of under standard procedures at that time,” Koskinen said.

Koskinen claimed that information from Lerner’s Blackberry could not be transferred to her new model because “Our Blackberries only display email that is displayed by our employees’ Microsoft Outlook emails, which is maintained on IRS servers.”

Koskinen also said that there’s no outside system to save IRS employees’ emails.

“There is no system outside the IRS, government or otherwise, that the IRS uses to back up or store emails,” Koskinen said.

Koskinen didn’t mention that the IRS terminated its years-long contract with its email archiving company Sonasoft shortly after Lerner’s computer crashed.


“It is not clear that there are backup tapes that have any information on them,” Koskinen said. “I never said they disappeared, I said they were recycled.”

But the IRS could have easily saved all records, information, and history on Lois Lerner’s Blackberry, according to a Blackberry user guide.

“If you have installed the BlackBerry® Desktop Software on your computer, you can back up and restore most of your BlackBerry smartphone data, including messages, organizer data, fonts, saved searches, and browser bookmarks using the BlackBerry Desktop Software. For more information, see the Help in the BlackBerry Desktop Software,” according to Blackberry.

“If your email account uses a BlackBerry® Enterprise Server, you might be able to restore synchronized organizer data to your smartphone over the wireless network. To restore synchronized organizer data over the wireless network, you must have an activation password. For more information, contact your administrator,” the Blackberry manual continues.

Koskinen said that if the agency destroyed records then “that was an act not consistent with the law” but said, “There’s no evidence that there were records destroyed.”

Koskinen also admitted that IRS employees routinely use personal email accounts to conduct agency business but maintained that “they do it inadvertently.”

IRS worker suspended for urging Odumbo re-elect

An IRS help line worker has been suspended for 100 days without pay for urging callers to reelect President Odumbo in 2012, the U.S. Office of Special Counsel announced on Thursday.

The employee, who was not named, “acknowledged that he had used his authority and influence as an IRS customer service representative for a political purpose and did so while at work,” according to a news release from the ethics watchdog agency.

The “complaint alleged that, when fielding taxpayers’ questions on an IRS customer service help line, the employee repeatedly urged taxpayers to reelect President Obama in 2012 by delivering a chant based on the spelling of the employee’s last name,” according to the release.

The incident is not related to the extra scrutiny the agency gave tea party-linked applicants seeking tax-exempt status.

The ethics agency entered into a settlement with the employee in June, with the IRS worker agreeing to a 100-day unpaid suspension for violating the Hatch Act, which prohibits federal employees from either running as candidates or soliciting contributions and promoting candidates for political office while they’re on duty and in a federal workplace. The settlement agreement announced resolves the formal Hatch Act complaint OSC filed with the Merit Systems Protection Board in April.

In the wake of the news, Rep. Charles Boustany (R-La.) blasted the IRS as “totally out of control.”

“This latest development exposes a culture that tolerates or even encourages politically motivated activities, contrary to the agency’s mission and purpose,” he said in a statement. “This is inexcusable. If the IRS wishes to preserve what little credibility it has with the American people, they will immediately terminate this employee and conduct a thorough internal review into this matter.”

An IRS official was not immediately available for comment.

The IRS commissioner was supposed to clean up the mess. Instead, he's running interference.

Nine months have passed since President Odumbo installed John Koskinen as IRS Commissioner, charged with unearthing the agency's targeting scandal and restoring its credibility. It's about nine months past time to acknowledge that Mr. Koskinen is the problem, not the answer....

The only thing Mr. Koskinen has seemed remotely interested in turning around is his agency's ugly story-line. He has yet to even accept his agency did anything wrong, spending a March hearing arguing that the IRS didn't engage in "targeting" and claiming the Treasury inspector general agreed. This was so misleading the Washington Post gave Mr. Koskinen "three Pinocchios, " noting the IG had testified to the exact opposite....

The "reformer" has bristled at every question. He's indignant that investigators might question how the Lerner emails were lost; indignant that they'd ask why her BlackBerry was wiped after their investigation began; indignant that they'd wonder why he didn't tell them about the lost email. We're still waiting for him to show any indignation at the IRS employees who abused the law, and hid the fact....

It's also a fair conclusion given the "independent" commissioner's embrace of partisan Odumbo policies, including the highly controversial regulation to formalize the targeting of 501(c)(4) nonprofit advocacy groups. Mr. Koskinen inherited that outrageous proposal, and the obvious course for anybody looking to restore IRS integrity would have been to immediately table it. Instead, Mr. Koskinen embraced it, defended it with Odumbo administration talking points, and only decided to delay it after an avalanche of criticism.
