Police: Bryan woman had Viagra in her purse illegally

A 26-year-old Bryan woman was charged with possession of a dangerous drug after police said they found Viagra in her purse.
Officers made contact with her and the driver, a 28-year-old Bryan man, as they pulled into the Twin City Condominiums at 1107 Verde Drive around 11:20 p.m.
Inside the car, officers noticed several scattered pills in the woman's purse, police said.
The woman told them the driver's father had given her the Viagra for sexual pleasure, according to the police report.
Possession of a dangerous drug is a Class A misdemeanor punishable by a fine up to $4,000 and up to one year in jail.
The man was charged with Class B misdemeanor of driving with an license invalid, which is punishable by up to six months in jail and a maximum fine of $2,000.
She remained behind bars Thursday in lieu of $4,000 bail. He was released after posting $2,000 bail.

Certainly not going to defend this. But simply as a discussion point.......

Neither the press report nor the police significant activities report will tell you WHY they pulled over the woman and "her driver".

I seriously doubt is was because they "just knew" she had a couple of loose Viagra in her purse. LOL.

It is cut and dry for the cops to get a drug bust, even for possession of prescription drugs (it is illegal to possess prescription drugs that are not prescribed to you, or to test positive for prescription drugs for which you have no script).

It is not so cut and dry to pull a lady in for soliciting or attempt.

I can tell you for a fact, that when the cops in Killeen pop a suspected provider, they go through her purse and belonging with a fine tooth comb, hoping to find drugs (legal or illegal) and will simply charge her with that, leaving the prostitution charges off the sheet. Case closed and certainly less paperwork or witnesses or time to deal with it.

I will go out on a limb and say the Bryan police feel the same way. It is an easy bust and stands up in court. Cop gets a good bust on his record and he doesn't have to do as much paperwork or coordination.


While this sucks, the learning point here is ladies who may be carrying something they don't want to get caught with, need to keep it someplace other than their incall hotel room or purse.

Just an observation.

What do they use to justify propable cause for the search?

They will say the stop was for "failure to maintain". Meaning you broke the lane line twice, not hard to do when you are watching a cop tail you. Once stopped, everything in the car is subject to search. They need nothing more. If you want more, the officer will state that he noticed "drug paraphenanelia" when she retrieved her ID. Drug paraphernalia includes illicit and legal drugs as well as pipes, baggies,cutters etc.
