Now I know it's silly and easy to see through but a loophole is a loophole right? Could it theoretically work?

Do you think a judge and jury would believe that to be true or do you think they'd believe that to be a sham and that she was really selling sex for money?

Theoretically, sure it could work, but in reality, nope.

The following would be more believable...

You are selling time/companionship. You have sex with clients when you are mutually attracted to each other, but he is not paying for the sex. He is paying for time/companionship. Of course, a jury would be suspicious if you find ALL of your clients attractive....

I don't see what you describe as a "loophole." A loophole is a defect in a law that allows a defendant to sneak through. (I sometimes hear right wingnuts describe basic constitutional protections as "loopholes," which is like fingernails on a blackboard to me.)

You've described a scenario that takes the same set of basic facts as the prosecutor has but provides a different explanation for those facts. Would it work? Of course not! It was a joke! Most other jokes on Facebook don't make good defenses to criminal charges, either.
