If you are in a position of power such as David Sterling or Paula Dean, you are opened to scrutiny whether self imposed like Paula Dean or set up by his girlfriend like David Sterling
Although I may agree with your rudimentary point of free speech...these days if you are in power or even not in power and you share your opinion...you are open to scrutiny including the consequences that have befallen David Sterling

He has the right to say what he wants. There is no charges against him for speaking his mind - that is the first amendment right. However, the NBA is a private company that has the right to do what it pleases after hearing what he said.
You can only cry first amendment if they were trying to charge him with some type of crime and take him to court over the recording. But since they aren't, the first amendment argument does not apply.

I'm not a constitutional scholar, but I can't see what the first amendment has to do with him expressing his bigotry. He can say whatever he wants, but he needs to live with the consequences. The first amendment says no laws will be passed prohibiting free speech. I haven't heard of any laws being passed prohibiting his free speech. So anyone saying his first amendment rights are being violated doesn't know what they are talking about.
You have the right to say what you want. Your employer has the right to hold you accountable if you violate any rules with that right to free speech. That would include discrimination, harassment, etc. NBA is a private entity and can take appropriate action against their own. Not all may agree, but that's life.
Don't be surprised if this all ends up in civil court. Sterling is a litigious individual and I don't think he'll hesitate one minute if the other 29 owners vote to take over his franchise to go to court in order to keep the NBA from selling his team. If they want to ban him from attending games and participating in association activities, I have no problem with that. But I do have a problem with the association forcing someone to sell his team against his wishes. I think he'll sell the team on his own after season ticket sales plummet, sponsorships leave and free agents decline to sign with the team....or he'll die (he's 81 for God's sake - he doesn't have long before he's taking a dirt nap).

I would not be surprised if he were to show up in any group attempting to purchase the team, because its a foregone conclusion that Sterling will be forced to sell.

I haven't heard everything he said, but what I heard sounded more like a jealous old man using hurtful (and racist) words to strike back out of anger.
I'm not saying he's not a racist (IDK), I'm just saying that it sounded to me like an old white guy who was insecure about his young, hot, mixed-race girlfriend showing a little attention to MJ, who could make just about any man feel insecure about his girlfriend.
So, what does he do when he becomes defensive? He uses MJ's race as a weapon of attack. I wonder if his motives were more anger and jealously than purely racist?
