In the article it says that he had access to her phone without her knowledge.
This means he had the password to her phone, and the password to her itunes account and had time to install the app and set it up.

Yes I understand there is usually very little if anything private between married folks.. but, just saying that it isn't all that easy either.
Be savvy and it is less likely things like that will happen.
