Maybe because he was not making contact with only one instead of both.....the judge can always say "mam look me in the eye and explain to me how one is supposed to make contact with both of your eyes..."

I feel bad for her. It is bad enough to get busted for shoplifting and having your mug blasted on the internet. But then someone photoshops your photo and attributes a heinous, but uncommitted crime to you.
