Is this legal?

I've looked online and can't seem to find a direct answer, maybe I'm the only person in the great state of Texas with this problem?

Can you be denied a ID? Not a TDL, but an ID?

I have lots of surcharges that DPS has now linked to my state ID as well, so when it expired and I went to renew it, I was denied because of my surcharges. I understand no TDL, but my ID? I have no good ID. Is this legal? Don't I as an adult have to be allowed to get a vaild ID?

2ed question, if I drive to another state to get an ID & TDL, do all my Texas troubles stay in Texas. Is it as easy as checking into a Marriott for a few days, using that as my address, then letting them know I'll be getting some mail and asking them can they please send it to Texas once it arrives?


* Just for full disclosure. I am not paying my surcharges, I have been getting them reduced for years, but they are still over 2k and you can only get them reduced every 6 months I believe.

But don't I need an ID to get a passport? Or is my BC & SS card good enough? Can I rent hotels and withdraw money from the bank with a passport?
check the website for what's needed.

there are some chicken and egg issues but it should work

as far as i.d.....it's the real deal anywhere and everywhere imo.
and you shouldda did this before the txid expired.

note to all: everyone should have a passport. it's cheap and easy if you're not in a hurry

I honestly didn't know they could deny me a state ID based on my surcharges. Thought they were only linked to your TDL and I swore years ago I wouldn't try getting one of those again until I was a senior citizen.

They just want you to pay what you owe to the state. You want an ID from the state you need to pay up.

I use a passport for my ID, it is better than American Express.

I swear I read at one time that you could only have one or the other but not both a tdl and id.

What I read on the Texas Department of Public Safety is a wee bit vague (as is most "legalese"), but tends to support their refusal. They seem to treat the ID same as the license, as a state-issued document subject to full compliance, including payment of all surcharges linked to your TDL.

The congressional REAL ID Act of 2005 covers identification, but Texas was granted an extension in June 2016. Until this takes full effect, and it is highly controversial, each state has sole governing power on the matter. Don't know what deadline was given.

Probably would be easier to get a passport as long as you have an official birth certificate. Banks should accept that since it's federal, and most legit businesses, but some of the idiot desk clerks at hotels, not so much.

Not "legal" but I had a fake ID that even fooled most cops that saw it......just saying.

Interesting. Thanks everyone. This answered all my questions and gave me some other good info that had not crossed my mind.

I do have my college picture ID as well but it does me no good at the bank or hotels but it satisfies police at traffic stops. And Thankfully since me not having a TDL is not related to DUI/DWI/Drugs or accidents they never really give me a hard time.
