Obama swore not to raise taxes on anyone making less than $200,000 so that means he has to pretend its not a tax. On the other hand his representative is going to argue to the Supreme Court that it is a tax, justified by the interstate commerce clause.
The Obama administration is literally holding two mutually exclusive positions and the press ignores it.
