Solicitation of Prostitution Under the New Texas Penal Code §43.021
Under the new Texas law, it remains a crime to solicit prostitution even if no money is exchanged
(or other form of payment) and/or no sexual conduct transpires.
It remains a crime in Texas merely to ASK FOR SEX in exchange for any type of payment.
What is changing is the severity of punishment:
the new law increases the potential sentence facing anyone convicted of the crime of solicitation of prostitution.

Beginning September 1st, the arrested john will be charged with the new crime of “Solicitation of Prostitution
” under Texas Penal Code §43.021 and will be facing a state jail felony or a 3rd degree felony sentence

Those convicted of a state jail felony face incarceration for a time period ranging from six months (180 days) to two years
along with a monetary fine of up to $10,000. Texas Penal Code §12.35.

Only the *buying* or attempt to buy sex becomes a state jail felony for the *buyer*, not the seller. A 2nd offense becomes a 3rd Degree felony with mandatory 2-10 years in prison. Since buyers can be both male and female or non-binary, the law applies to all buyers.

Example... a lady on P411 offers to sell sex. She is arrested and is charged with the same Class C misdemeanor. LE offers her a deal to expunge her record in return for the identity of one or more clients who bought sex from her post 9/1. Those clients are then arrested and charged with a felony. The lady perhaps has her p411 account seized by LE who uses it to snare other clients attempting to buy sex.

Not clear if a conviction requires the felon to register for life as a sex offender but in this anti-freedom #metoo era anything is possible.

Which brings the question.. What will Ladies do to mitigate the increased risk for the Johns going forward? Can they do anything different?

The best system, which will never work in the Indy sphere, is to have a set, known rate, like AMPs and Studios have, so money never needs to be discussed. Outside of that, what other measures can Indies incorporate to better facilitate less risky transactions?
So how does that affect some of these sites: Ashley Madison, Secret Benefits, Secret Arrangement, etc.


Also, how does that affect Strip Clubs?

Slight correction-- first offense for a lady is a Class B Misdemeanor. It jumps to a State Jail Felony for the 3rd and all subsequent occurrences. It is very common for ladies to be convinced into pleading down to a Public Lewdness charge (if they're streetwalkers) or a Commercialization of Sex charge if they are on the "internet stroll".

What's the definition of buying sex here? Is it legal to hire someone to watch you masturbate for instance, or to watch a couple to have sex?

I'm assuming there's a limit to how far the cops will go with police stings on this. Maybe providers should just make potential clients get on video chat and jerk off for $50 via Bitcoin or Monero before they book an appointment, or make them show they're wearing a buttplug or a variety of things an undercover LEO can't or won't do cause it won't fly in front of a jury.

Even if you offer a ride somewhere in your car in exchange for sex, or offer to buy someone dinner, or pay rent, or buy clothes, in exchange for sex, it is a state jail felony. The 2nd offense carries a mandatory two years to ten years in state prison.

Solicitation first offense in Texas is now more serious or as serious as drunk driving. 2nd offense as serious as kidnapping. The law passed unanimously, so likely a few hypocrite politicians voted in favor.
