Girlfriend wants to charge for people to watch us have sex

Well, she wants to post on Craigslist and charge $99.95 (don't ask) per ticket for people to come and watch us have sex. Ignore the marketing and whether or not people would show part, this question is strictly on legality. She talked about other couples where we would have a sensual show and then another couple do a harder session. Slapping and more hardcore.

No audience participation other than watching. We would maybe also live stream or receord to video (not the audience.)

Is this legal? If not, then what section of theTexas penal code is violated?

This question has come up in this forum before. No, live sex shows are illegal in Texas. What you're describing would probably be the offense of obscenity under Texas law. Texas Penal Code section 43.23(c)(2) states: "A person commits an offense if, knowing its content and character, he ... produces, presents, or directs an obscene performance or participates in a portion thereof that is obscene or that contributes to its obscenity."

See Texas Penal Code § 43.23.

The State doesn't have to prove a fee was charged to prove a violation of the statute. The offense is a Class A misdemeanor, punishable by up to one year in county jail, a $4,000 fine, or both.

Why not just do webcam shows on chaturbate.com or some other site that allows M/F shows?

You'll get watched and can make some money while avoiding the logistics of an in-person audience. I don't know if this passes the legal test, but I'm sure someone else can answer that part.
