The court has allowed Sarah Palin's defamatory case against the New York Times to go forward into jury selection. Back in 2011, the NYT published an editorial where they reported that Sarah Palin's rhetoric was directly responsible for the shooting of Gabby Giffords. The NYTs removed that part of the editorial but did not retract or apologize for writing it.

I'm reminded of a true story of a slander (libel for those anal about it) case against the Corpus Christi Caller Times (Texas) many, many years ago. The Times published an editorial about a Corpus Christi mayoral candidate in which the Editor publishing the editorial called the candidate a "son of a bitch." During the trial the Times put on an old crusty cowboy from a ranch in West Texas and to the Judge's satisfaction qualified him as an expert on "son of a bitches." The expert after relating his acquaintance with the plaintiff-candidate testified: ....if I've ever known a son of a bitch he's one ... not an exact quote, but almost perfect. The Times won .... and the problem is that the candidate had from then on a jury finding that he was in fact a "son of a bitch"!
