According to trace documents, Uriel Patino, a chief firearms trafficking suspect whom ATF secretly advised U.S. gun shops to sell weapons to, is associated with 128 firearms traces to date, including 15 cases in 2014. A trace indicates a firearm likely turned up at a crime scene. Among the Patino traces in 2014 are 11 incidents in Mexico and four in the U.S....

“These weapons that have been recovered recently in 2014 haven’t even been reported to Congress,” says an official source familiar with the ongoing investigation into the government’s conduct. “It’s a life and death situation. People are using these weapons at shootouts, gang-related activity and cartel activity”....

In a separate revelation today [16 October 2014], Sen. Charles Grassley, R-Iowa and Rep. Darrell Issa, R-Calif. confirmed that an AK-47 rifle used in a July 29, 2013, gang-style assault that wounded two people in Phoenix was a Fast and Furious weapon. The conservative watchdog Judicial Watch originally obtained the documents showing the connection through a Freedom of Information lawsuit against the city of Phoenix. The rifle was one of 40 weapons purchased by Fast and Furious suspect Sean Steward while he was under ATF surveillance. ATF let the guns “walk,” allowing Steward to traffic them to Mexico....

Judicial Watch sued the Justice Department over the withheld documents and a federal judge has ruled that the government must turn over some information by October 22.

Shortly after that ruling, Attorney General Holder announced plans to retire but did not provide a reason for the timing of his announcement.

Sen. Grassley and Chairman Issa took that document Judicial Watch obtained and compared it to other documents they obtained from the Fast and Furious investigation to confirm it was indeed bought by a Fast and Furious straw purchaser. Grassley and Issa revealed the finding in a Thursday letter to Deputy Attorney General James Cole, the number two highest-ranking official at the Department of Justice, who announced his plans to resign the DOJ shortly thereafter on Thursday. Cole said in an interview with The Washington Post that he plans to leave because he wants to work in the private sector, but he did not say it had anything to do with Fast and Furious.

Judicial Watch announced today that it received from the Obama Department of Justice (DOJ) a “Vaughn index” detailing records about the Operation Fast and Furious scandal. The index was forced out of the Obama administration thanks to JW’s June 2012 Freedom of Information Act (FOIA) request and subsequent September 2012 FOIA lawsuit (Judicial Watch v. Department of Justice (No. 1:12-cv-01510)). A federal court had ordered the production over the objections of the Obama Justice Department.

The document details the Attorney General Holder’s personal involvement in managing the Justice Department’s strategy on media and Congressional investigations into the Fast and Furious scandal.

Notably, the document discloses that emails between Attorney General Holder and his wife Sharon Malone – as well as his mother – are being withheld under an extraordinary claim of executive privilege as well as a dubious claim of deliberative process privilege under the Freedom of Information Act. The “First Lady of the Justice Department” is a physician and not a government employee.

This is the first time that the Obama administration has provided a detailed listing of all records being withheld from Congress and the American people about the deadly Fast and Furious gun running scandal. The 1307-page “draft” Vaughn index was emailed to Judicial Watch at 8:34 p.m. last night, a few hours before a federal court-ordered deadline. In its cover letter, the Department of Justice asserts that all of the responsive records described in the index are “subject to the assertion of executive privilege.”

The Vaughn index explains 15,662 documents. Typically, a Vaughn index must: (1) identify each record withheld; (2) state the statutory exemption claimed; and (3) explain how disclosure would damage the interests protected by the claimed exemption. The Vaughn index arguably fails to provide all of this required information but does provide plenty of interesting information for a public kept in the dark for years about the Fast and Furious scandal.

Based on a preliminary review of the massive document, Judicial Watch can disclose that the Vaughn index reveals:

• Numerous emails that detail Attorney General Holder’s direct involvement in crafting talking points, the timing of public disclosures, and handling Congressional inquiries in the Fast and Furious matter.
  
• President Obama has asserted executive privilege over nearly 20 email communications between Holder and his spouse Sharon Malone. The administration also claims that the records are also subject to withholding under the “deliberative process” exemption. This exemption ordinarily exempts from public disclosure records that could chill internal government deliberations.
  
• Numerous entries detail DOJ’s communications (including those of Eric Holder) concerning the White House about Fast and Furious.
  
• The scandal required the attention of virtually every top official of the DOJ and the Bureau of Alcohol, Tobacco and Firearms (ATF). Communications to and from the United States Ambassador to Mexico about the Fast and Furious matter are also described.

For the first time, the Department of Justice has provided a detailed description of 15,662 Fast and Furious-related documents it is withholding from Congress, the public and the press under executive privilege exerted by President Odumbo.... the list describing them is 1,323 pages long....

Among the withheld communications is a March 8, 2011 email from a Mexico-based Bureau of Alcohol, Tobacco and Firearms (ATF) official less than one week after federal agent John Dodson blew the whistle on Fast and Furious in an interview with me for CBS News. The email is described as “discussing response to [Mexico].”

Another withheld email sent in the same time period is from then-White House official Kevin O’Reilly. Dated March 10, 2011, it was sent to more than a dozen federal officials and is described as, “discussing draft press statement”....

Other emails being kept secret are dated May 4, 2011 from Assistant Attorney General Lanny Breuer [one of Holder's chief lieutenants] to other officials in the Justice Department about a news article revealing Breuer authorized the wiretap in Fast and Furious. The justification for the wiretap included a detailed narrative on the case, implying Breuer would have known that the gunwalking tactic was being used, contrary to his and the Justice Department’s claims.
