STATEMENT BY BOB RASKOPF, TRADEMARK ATTORNEY FOR THE WASHINGTON REDSKINS

LOUDOUN COUNTY, Va. – The following is a statement by Bob Raskopf, trademark attorney for the Washington Redskins, regarding today’s split decision by the Trademark Trial and Appeal Board:

“We’ve seen this story before. And just like last time, today’s ruling will have no effect at all on the team’s ownership of and right to use the Redskins name and logo.

We are confident we will prevail once again, and that the Trademark Trial and Appeal Board’s divided ruling will be overturned on appeal. This case is no different than an earlier case, where the Board cancelled the Redskins’ trademark registrations, and where a federal district court disagreed and reversed the Board.

As today’s dissenting opinion correctly states, “the same evidence previously found insufficient to support cancellation” here “remains insufficient” and does not support cancellation.

This ruling – which of course we will appeal – simply addresses the team’s federal trademark registrations, and the team will continue to own and be able to protect its marks without the registrations. The registrations will remain effective while the case is on appeal.
When the case first arose more than 20 years ago, a federal judge in the District of Columbia ruled on appeal in favor of the Washington Redskins and their trademark registrations.
Why?
As the district court’s ruling made clear in 2003, the evidence ‘is insufficient to conclude that during the relevant time periods the trademark at issue disparaged Native Americans...’ The court continued, ‘The Court concludes that the [Board’s] finding that the marks at issue ‘may disparage’ Native Americans is unsupported by substantial evidence, is logically flawed, and fails to apply the correct legal standard to its own findings of fact.’ Those aren’t my words. That was the court’s conclusion. We are confident that when a district court review’s today’s split decision, it will reach a similar conclusion.

In today’s ruling, the Board’s Marc Bergsman agreed, concluding in his dissenting opinion:

It is astounding that the petitioners did not submit any evidence regarding the Native American population during the relevant time frame, nor did they introduce any evidence or argument as to what comprises a substantial composite of that population thereby leaving it to the majority to make petitioner’s case have some semblance of meaning.
The evidence in the current claim is virtually identical to the evidence a federal judge decided was insufficient more than ten years ago. We expect the same ultimate outcome here.”

Not a big deal! Supposedly the 'foreskins' have lost the patent one time before and they won the appeal...which most likely they will win again.

Is calling the Redskins, "foreskins" similar to calling the Cowboys, "cowgirls?"

I'm in contract law & this is utter RUBBISH! The Skins should win this easily unless their attorneys are donkeys. That saying...I personally feel they should scrap the name. It is indeed offensive.

I personally don't care if they are called the Washington Redskins, the Washington Skins, whatever.. I'm not really trying to rebuy jerseys and etc.. I just wonder where this stops. We are always so worried about offending others.. If the name has to be given back, why stop there? The bigwigs in DC should give back the land to the Natives too...

The only thing they should change is Washington to Maryland.

Here is an email sent to Clarence Page of the Chicago Tribune after
an article he published concerning a name change for the Washington Redskins.

Dear Mr. Page...

I always love your articles. and I generally agree with them. I
would suggest, as in an email I received, they change the name to the
"Foreskins" to better represent their community, paying tribute to
the dick heads in Congress.

Here are some other politically correct issues to consider: I agree
with our Native American population. I am highly insulted by the
racially charged name of the Washington Redskins. One might argue
that to name a professional football team after Native Americans
would exalt them as fine warriors, but nay, nay. We must be careful
not to offend, and in the spirit of political correctness and
courtesy, we must move forward. Let's ditch the Kansas City Chiefs,
the Atlanta Braves and the Cleveland Indians. If your shorts are in
a wad because of the reference the name Redskins makes to skin color,
then we need to get rid of the Cleveland Browns.

The Carolina Panthers obviously were named to keep the memory of
militant Blacks from the 60's alive. Gone. It's offensive to us white folk.

The New York Yankees offend the Southern population. Do you see a
team named for the Confederacy? No! There is no room for any
reference to that tragic war that cost this country so many young men's lives.

I am also offended by the blatant references to the Catholic religion
among our sports team names. Totally inappropriate to have the New
Orleans Saints, the Los Angeles Angels or the San Diego Padres.

Then there are the team names that glorify criminals who raped and
pillaged. We are talking about the horrible Oakland Raiders, the
Minnesota Vikings, the Tampa Bay Buccaneers and the Pittsburgh Pirates!

Now, let us address those teams that clearly send the wrong message
to our children. The San Diego Chargers promote irresponsible
fighting or even spending habits. Wrong message to our children.

The New York Giants and the San Francisco Giants promote obesity, a
growing childhood epidemic. Wrong message to our children.

The Cincinnati Reds promote downers/barbiturates . Wrong message to
our children.

The Milwaukee Brewers---well that goes without saying . . . Wrong
message to our children.

So, there you go. We need to support any legislation that comes out
to rectify this travesty, because the government will likely become
involved with this issue, as they should. Just the kind of thing the
do-nothing congress loves . . .

As a die hard Oregon State fan, my wife and I, with all of this in
mind, it might also make some sense to change the name of the Oregon
State women's athletic teams to something other than "the Beavers."
