Subterfuge

Take an idea that most people can agree with, say something like, "Americans who take up arms against America can be treated as enemies." Then insert a patently un-Constitutional line like, "Only the executive branch can determine who is an enemy of America". In fact, the statement indicated the executive branch had the final say-so rather than the judicial branch, and didn't even mention the legislative branch (the branch that actually DOES have the sole authority to declare war).

Are these people over-reaching statists, or just stupid?
