WASHINGTON — A second federal appeals court has ruled that President Barack Obama exceeded his power in making a recess appointment to the National Labor Relations Board.

There weren't "hundreds of rights". All of the appointments were wrong - by both parties.

Obama got burned. But it was his turn and it was long overdue. The fact that other presidents - both Democrats and Republicans - going back 100 years before him had done similar things doesn't make his appointments any less unconstitutional.

I don't think the court stated that recess appointments were unconstitutional. The case was focused on whether recess appointments while Congress is still in session were unconstitutional.

How many of those prior recess appointments in previous administrations were made while Congress was in session?
