Measure Would Try New Tactic to Fight Prostitution

Eric Johnson (D-Dallas) says his proposal would make a first or second office of prostitution to a Class C misdemeanor, which is like a speeding ticket. It calls for a fine of up to $500, but carries no jail time.

Currently, first offense prostitution is a Class A misdemeanor, which carries up to a year in jail....

Texas laws on prostitution today are draconian. Currently, fourth offense arrests are felonies with time in a State Jail Facility....

Johnson stresses that his bill would maintain penalties for the crime of soliciting prostitution.

The reality is that peace officers have a lot of discretion in what to charge OR to charge at all, but that discretion is "curbed" by departmental and prosecutorial discretion, which is often driven by special funding.

There might be better luck if a city ordinance were passed creating an "alternative" for a "city charge' the officer can "write" in lieu of the Texas Penal Code provisions.

For instance until MADD got involved in DWI's many towns passed an ordinance called:

"Public Intoxication in a Motor Vehicle" for which a ticket could be issued after the person sobered up in the local holding facility. Some still have it on the books.

We have had 6 1/2 years of the most liberal administration in the nation's history and still no real movement on the Hobby. What about a series of Executive Orders on this? Where is Eric Holder on this? Why can't we have a Federal approach that mirrors the European model?
