Despite what prosecutors considered overwhelming evidence, a Jury could not vote to convict this defendant in the brutal attack on this elderly store owner.

Perhaps this is a case of jury nullification. Or perhaps the evidence was not as “overwhelming” as the prosecutors believed.

The Prosecutors say they will retry the case. The link did not say whether the defendant will be out on bail in the mean time.

This story was just on Fox News, and a local civil rights Attorney said that since the jurors could not see the man’s face because of the mask, they could not vote to convict.

All of the evidence presented at trial was “circumstantial”.
