actually it was an Obama era proposal that was decided by the GAO later under Trump as not cost effective. and it would have applied to gas/oil tankers so wouldn't have been mandated on these type of railcars which is a bit odd to not to include tankers with hazardous materials. and speed wasn't a factor here so it wouldn't have prevented this accident.
as for fema they have been acting but not nearly as well as they should but according to fema in a classic example of gov redtape this issue ultimately belongs to the epa and it's their job to engage fema. so it's the epa that apparently is driving the response and not with much documented urgency.
