Our day in court! FINALLY!!!

Thank you Duke...I wasn't sure when I posted but I figured you guys would straighten me out!

Day 2 at the courthouse, first day of actual deliberations. I had half my time on the stand this afternoon and will finish in the morning.

It all appears to be going well, but do you ever know until it's all over? Something about a fat lady playing guitar or something?

Okay...3 days down. I finished my cross examination this morning and it wasn't TOO bad...some very off the wall questions but I'm done now.

Their side will begin calling in witnesses tomorrow so it should be very interesting. Their stories are all over the place so it will be entertaining if nothing else.

We MAY be finished Friday...sure hope so!

Good luck V. I hope everything works in you favor. The problem with courts and jury's is you have better luck at a casino because juries are all over the place and most are brain dead and don't listen to the case to begin with.

Hopefully we'll be finished tomorrow. I really can't share any details until then but it is a pretty good story at times! Parts of it would make a great television sitcom!

I haven't spoken with my attorney today as I wasn't at the courthouse. I spent the day with my dad to let the lawyers do their lawyer stuff. It was actually a nice break!

Okay...I REALLY appreciate everyone's kind words and wishes but I am very sorry to say that we lost our case. Maybe typing about it will help the myriad of feelings that I am experiencing.

This was a personal injury/slip and fall case. I work for a different personal injury attorney so I already know that only about 20% of these type of cases are won.

My dad slipped in grease at a car dealership in North Richland Hills in December 2007. The grease had been there so long that it was covered with dirt and/or dust and it blended into the concrete in appearance. He fractured his hip which required surgery which led to heel ulcers which required surgery and the entire ordeal left him disabled and immobile. He was 75 at the time and had just purchased a new truck from the same dealership about 6 weeks prior to his injury so needless to say, he was TOTALLY independent at the time.

Sparing all the boring stuff, our attorney is just about the best in the State of Texas and is actually on record for winning the largest personal injury suit in the history of the State. He was and is amazing!

He proved that there were falsified records, lies under oath, conflicting stories and generally rude folks. All of our witnesses were right in sync and our story never wavered. Seeing as how it was the TRUTH, it was very easy to "keep our stories straight".

The jury deliberated for less than one hour and voted us down 11 to 1. Unbelievable. This case was for a buttload of money but it would have been the jury's decision as to the final amount of the award.

With all my heart, I can say that I couldn't give a rats ass about the money. If they had found in our favor and awarded $2, I would have been fine with that. The people at that dealership caused my father's life to end as he knew it on that day in December and are now calling him (and all of us who testified) liars and I am having a very difficult time processing this.

I don't know about ALL car dealerships but this particular one has had many, many undocumented accidents so they have just gotten away with screwing people over again. The incident report they filled out on my dad was done in May 2008 only after they had received a letter from our attorney and it even stated that my dad had slipped in grease. Really?

That's about all there is to tell except that this case should have been won. Our attorney spent over 4 years and $70K on this. Being the best, you'd think he would have good insight and I am certain that he did. You don't get as successful as he is without being good. I wish I knew of some way to check over the next month to see how many jurors are driving new cars.

I suppose we could appeal the decision but that will be up to our attorney. I haven't spoken with him since he called me with the results on Friday evening but I'm sure we will be talking soon.

By the way, I wasn't able to be at the courthouse because my dad went into the hospital on Wednesday. He was pretty sick but is seemingly doing better. Hopefully he will get to come home by mid-week.

I feel bad for him because he's the most honest man I have ever known and has always lived right and done the right things. To be so screwed over like this is just worse than disgusting.

Just the other day down here in Corpus Christi, this lady sued Coca Cola because their driver was on a cell phone and hit her. She was awarded $24 million! I would recommend this lawyer from here. I am very sorry you lost, but the dealerships insuance policy should have just stepped up and covered all your needs. This must be a very low level dealer. I cant out my self but my place would have done that and made sure you were taken care of

My deepest condolences for a loss suffered by a righteous plaintiff, V-Nurse.

Your Dad has suffered life-changing and most likely, life-shortening injuries.

The "Tort Reform" crowd has poisoned the public and, with it, the "jury pool" by falsely reporting and publicizing large jury awards as though they were excessive, unneeded and have even described them as a "blue-collar lottery".

Every person who participates in this speculation and stereotyping and spreads it without hearing ALL the facts should have to suffer some of the injuries they so callously dismiss.

In most of these cases, all you hear about are the distorted stories spread by giant corporations. These wealthy defendants hire others who do their bidding by misleading others and doing their best to distract from the truthful stories.

Genuine damages and injuries suffered at the hands of these corporate bullies is simply a financial or "bottom line" decision that the bad behavior is more profitable than fixing the problem or changing their behavior.

Those moneyed bullies will continue to tell an untruthful narrative about persons who get their day in court and a lot of their lies will remain in the backs of the minds of jurors and media pundits who will poison others.

I suggest getting a copy of "Hot Coffee" and watching what that poor woman went through because McDonalds wanted to keep their coffee far too hot for far too long.

There are many reasons McDonalds did what they did. Among them are to have the coffee stay hot on the customer's commute and be at the best temperature to drink once they got to work or after to stay hot at the store after customers stirred in temperature-lowering additives like cream and sweetener.

All of those actions were conscious choices that the overall bottom line was more important than the safety of their customers.

The now-deceased victim suffered third degree burns that required skin grafts from her inner thighs - a horrible fate even for any person, let alone one who was elderly.

And it wasn't McDonalds first mishap or notice that they were doing something dangerous.

V-Nurse, may the Karma your Dad deserves soon smite the dealer and those responsible for both the injury AND the horribly unjust decision!
