It all comes down to your agreement with the guy you bought the house from. If it is in writing and part of your payment was supposed to go into an escrow account you may have some recourse?
I knew a lady who made her living off of rent to contracts with clause' in them that if you missed your payment by 3 days the contract was broken. She would get large down payments from people then wait for the payment to be late.

Seriously sucks... I've had my share of legal issues with real estate. Please get an attorney to intervene on your behalf. You'll get many opinions, and natural instinct will be to go with the one that most tells you what you want/hope to hear. Get some real legal advice...

It's kinda like the ol' joke: why is divorce so expensive? Because it's worth it LOL see a lawyer if you have a legal contract I believe there'd have to be some recourse - but again, what do I know? Lawyer up!

NY state is weird in my opinion as well... this had been the only state I've lived in that required a lawyer when I purchased a foreclosure. Had to go to county court to close and file papers, etc. Seemed overly complicated to me. Michigan was much easier IMO.

Thankyou for all of your comments and advice.. ik this is a hooker board and all but it's nice to have you all to reach out to and get info and advice from or even just a kind word of encouragement, it really does mean a lot to me..
So tmrw I go talk to the lawyer, got out my paperwork that was written up by his lawyer and notorised staying that he was responsible for the taxes till the property was paid in full by me.. not sure how talking to a lawyer will stop nys from auctioning my house but im doing all I can and trying to be ok..

Bottom line , the seller has breached the contract and could be court ordered to adhere to it's terms which could fore stall the tax auction deadline, chances are your attorney will set up an escrow account to hold your payments until it gets resolved, good luck babe!
