Texas Gov Abbott really hates providers and clients!

I see that the May 17th version of this bill section 29 did not upgrade the charge to felony. I'd be slightly surprised if it was Democrats that pushed in this wording in at the last minute given their focus was preventing abortion law and election law changes.

While some feminists hate the idea of legalized or decriminalized sex work it's usually due to Marxist sympathies and patriarchal contagion fears. They tend to like to Nordic model, i.e. punish men.

The omniscient guy in the sky who worries an awful lot about what 3.5 billion penis wielding humans do with the holes of the 3.5 billion non-penis wielding humans probably inspired the last minute punishment enhancements I'm betting.

I’m confused as to whether a first time offense is a felony. In your link “Class A Misdemeanor” is crossed out which might mean it is.

Can you blame this entirely on Abbott? Or is it the legislature or lawyers working for the state who came up with this crock of shit? Originally Posted by Tiny

https://www.shouselaw.com/tx/defense/felony/state-jail/

A conviction for a state jail felony carries the following penalties:

up to $10,000 in fines, and/or

between 180 days and 2 years in jail.

Unlike other felonies, there is no parole for state jail convictions. Inmates cannot shorten their sentence by getting good time credits. Instead, they have to rely on Diligent Participation Credits. These credits can shorten a jail sentence by 20 percent.

State jail felonies are still felonies. These convictions carry serious collateral consequences. People convicted of a state jail felony can still:

lose their right to vote,

be prohibited from owning or possessing a firearm,

become ineligible for federal student loans and professional certification programs, and

have to disclose a prior felony offense to potential employers.

So it sounds like the least amount of time you'd serve would be 20% less than 180 days, or 144 days, although perhaps you'd get off with just a fine instead of jail time.

Should be noted that plenty of Democrats joined in, as well, in support of a feminist agenda against sex work. Originally Posted by SecretE

Aren’t several States looking to decriminalize prostitution?

Not a law I'll have to worry about ( well, I don't live in Texas but ) since nobody is answering my phone calls or e-mails. Last 3 attempts on Eros have come up dry. I think I'm up to about 15 "dry holes" if you'll pardon the pun. Use to be as easy as ordering a pizza here in South Florida, WTF?

Remember FOSTA/SESTA? Rand Paul a Republican was one of only two senators who voted against it

You're 100% correct as far as the Democrats sharing the blame. I checked further and the person that put in the last minute amendment to escalate the 'crime' to a felony is a Democrat from Houston. I don't think I'm going to go through the trouble of reading the transcripts of the session to see who said what so who knows what the context of the change was assuming it was even discussed out loud.
