skirt, I know there are many, many good places around that would have done the right thing but we just happened to not be at one of those.
Stevie, I appreciate your thoughtful post too...it really does suck! The thing is, I would have been okay with a positive verdict and little or no monetary award. This was all jury driven, by the way.
It's over, it's done...at least as far as I know. I am actually quite sick of even thinking about it!
Life goes on and no one EVER said it was fair, right?

Very sorry to hear about the loss. An all too common story these days. Stevie hit the nail on the head. The so-called "Tort Reform" movement is little more than jury tampering by advertising. And very misleading advertising at that. As an attorney who represents the injured, we go into court with two strikes against us in the mind of most jurors. As a result, instead of just having to prove our case by the legal standard of the "preponderance of the evidence," we have to make the Plaintiff's case very convincing.
I also handled a car shop slip and fall for an elderly customer several years ago. It is a very tough type of case to win. We settled our case for about a third or a quarter of what it would have been worth 25 years ago, but did get some recovery for the gentleman in question. But our suit was filed in a much more Plaintiff favorable venue than Dallas (or any of the surrounding counties).
Finally, as to what you can do, Stevie hit the nail on the head again. Watch "Hot Coffee." Get the word out to people that you know that our jury system is under attack and the minds of jurors isn't unbiased as it should be. And most of all, when you get called, go for jury duty. All the people who's are against us show up every time.
