The U.S. flag is a symbol of this country. There is a "property" interest in the symbol, and the attack on the symbol is an attack on that interest. When it's "convenient" you focus on the physical ownership of the item, and I'm focusing on the exercise of a freedom.....if one can justify the destruction of the symbol I can justify the destruction of the property on the same basis.

I remember this lesson from the Boy Scout Handbook:

A U.S. flag should be retired when it is ripped, faded, frayed or otherwise unserviceable as an emblem of the country. Though U.S. Code does not provide specific details on methods of destroying unserviceable flags, the American Legion developed its own ceremony to destroy flags respectfully through burning. Some chapters of the American Legion, VFW, Boy Scouts and Girl Scouts accept public donations of damaged flags for retirement ceremonies.
Individuals are also permitted to dispose of their own flags privately. Though there is no legal penalty for improper disposal of the flag, groups such as the American Legion consider improper disposal disrespectful

The "issue" regarding "flag burning" is not relevant to "disposal" of a damaged or otherwise "non-serviceable" U.S. flag .... it has to do with the symbolism it represents, along with some blood and cuts spilled into order to assure the continued existence of the "symbolism" that is being disrespected and marginalized by some.

There is no "Constitutional Right" to burn the U.S. flag any more than there is a "Constitutional Right" to an abortion. At one time in our history the original "Amendments" didn't even apply to the States by interpretation of the SCOTUS.... AND from there were carved many "protections" applying to the States as well as the Feds as the original Amendments are "interpreted" in any given time by the then existing Justices.

The Eichman case seems pretty clear. The burning of a flag privately owned as an act of protest is subject to the highest scrutiny and protected by the First Amendment. That's my position, too. Surprised that I agree with Justice Brennan, but he had his good days.
