The U.S. flag is a symbol of this country. There is a "property" interest in the symbol, and the attack on the symbol is an attack on that interest. The "issue" regarding "flag burning" is not relevant to "disposal" of a damaged or otherwise "non-serviceable" U.S. flag .... it has to do with the symbolism it represents, along with some blood and cuts spilled into order to assure the continued existence of the "symbolism" that is being disrespected and marginalized by some.

There is no "Constitutional Right" to burn the U.S. flag any more than there is a "Constitutional Right" to an abortion. At one time in our history the original "Amendments" didn't even apply to the States by interpretation of the SCOTUS.... The Eichman case seems pretty clear. The burning of a flag privately owned as an act of protest is subject to the highest scrutiny and protected by the First Amendment. That's my position, too. Surprised that I agree with Justice Brennan, but he had his good days.
