The rights you are referring to do not apply in this case.
POWs are not detained for prosecution.
They don't get trials because they are not being prosecuted for crimes.
They are detained to prevent them from reentering the conflict and must be released after hostilities have ended.
Since hostilities obviously haven't ended we could still keep the sorry sob in gitmo indefinitely.
