Reagan may have signed it, but it was the Democrat House that created the act as part of the Reconciliation game with the Republican Senate.

theres a problem with this thinking....

you had Obamacare in place since 2009. Hospitals are still getting EMT visits and they are still not getting paid under ACA to cover these visits.

ACA is/was not meant to fund EMTALA. all it did was move somethings around and the hospitals took advantage of the ACA incentives which reduced some of EMTALA costs. complicated shit.

there is a lawsuit challenging the constitutionality of the EMTALA.

EMTALA constitute an illegal 5th amendment taking.

the 11th district court upheld EMTALA as saying the hospital's involvement with medicare is voluntary.
