A new millionaire at 18

I was adding up both wapo and cnn

and yes probably over 150 million

the liability insurance limits were likely reached

if you think the high powered lawyers for nick sandman settled for 1 million, you've never been involved in litigation Originally Posted by nevergaveitathought

Unless you are talking about a mass tort with tens of thousands of victims, NO ONE settles for $150 million. You might as well go to trial - you can't do any worse. And insurance companies will NOT simply pay that much money. The insurance companies are the ones who control the litigation, NOT WaPo and CNN.

I think WaPo smeared Sandmann, but there is a limit to how much you can get in damages - especially if you don't have a career or business that got ruined. Sandman doesn't have that yet: he's a high schooler. So, his damages are mostly abstract - like emotional distress.

If they lost at trial, they would probably pay AT MOST in the low millions, especially after the trial court and appeals court got done reducing damages.

Each case was settled for somewhere between $500K and $5M - most likely on the lower end of the spectrum. If Sandman got all 8 defendants to pay $500K, he will walk away with $4M after the lawyers get their cut.

“The settlement amount is confidential, but likely was in the millions given the intrusive nature of discovery Sandmann's attorneys would have into the CNN newsmaking process, and the cost of continued defense," he said

the he is cornell law school professor william a. . jacobson

the settlement he discusses is the first one, with cnn

and yes ive been involved in litigation

twice, won both times but it was exhausting and costly

I was guessing, cnn was sued for 275M, wapo for 250M, settled for 75

times 2 (cnn and then wapo) = 150 less attorney fees and expenses

so who knows, but its not $500 k that's preposterous

But what damages does Sandman ACTUALLY have? His feelings were just? How is that worth a quarter billion?

Here is a test: what is the biggest libel award you heard of in the US in the last 5 years? And I mean an award that was UPHELD on appeal - not just some insane jury award that later gets reduced by 90%.

There is NOTHING remotely in that ballpark. It is extraordinarily difficult to get over $5 million and have it upheld on appeal. You just can't prove that much in damages unless you have an operating business that was bankrupted by a lie. And those cases are rare.

Why does his age work against him? I think it works FOR him. At the time, he was a minor and hardly a public figure. There certainly was a concerted effort to destroy a child. I did not think he will get what Wood is asking, but he’s going to get plenty. If the claim was a low number, WaPo would have leaked it by now. Originally Posted by bambino

WaPo/etc... aren't going to go any higher than that.. because they know in court the kid wouldn't be awarded more than about 5 mil. And honestly, its arguable that he would have won if they had taken it all the way... At least.. anything more than a hand slap of a penalty.

Innocent parties settle all the time... I mean, think of how many people still want to claim that Trump did nothing wrong with all his numerous settlements over the years.

Richard Jewel used the same lawyer that this kid is using.

the only reason this happened is because Sandmann was wearing a MAGA hat and that asshole injun phillips used it as an excuse to cause a "incident" which it wasn't. phillips created a fake issue.

these media companies are caving in because they rushed to create yet another so-called "race" incident. when the truth came out they tried to walk away. a retraction would have saved them a lot of money.
