Sexual consent

Curious to see if I can do something.

I had sex with a guy and I consented to protected sex but not unprotected. He managed to have sex with me without protection knowing I didn't consent to that. Say he purposefully took off the condom without my knowledge.

Is it possible for me to take this to court and file charges in TX?
Was this in a work (pay for play) environment or civilian environment?

I'm not sure if the courts actually do much when it's a dispute between client and escort.

Though I do believe if civilian it might, just might, be considered aggravated sexual battery.

It was initially work related, but since he left me stranded and also didn't pay me, I would think it was a civilian encounter.
Chalk it up to a lesson learned. You would have to prove it, which would be extremely difficult to do. And the fact that it was consensual to begin with - as long as he remained covered - means that there is no cop anywhere that would even take down your information to start the process.

I also thought of the proof part. But mainly wondering if condom sabotage was directed to in court cases.

The only way I could "prove it" is if he admitted to it. Which I doubt.

And as for lesson learned, I changed my screening process and more guys may feel uncomfortable. But potential clients can all thank the guy I saw.

Regarding the OP's questions, a complaining witness doesn't "file charges." A CW makes a report to LE, LE sends the report to the DA, and the DA decides whether to pursue charges. In Texas, if the offense is a felony, the DA presents the evidence to a grand jury, which votes whether to charge (indict) the suspect.

I don't know what you would gain by pursuing a charge of rape, assault, or something else, unless he gave you an STD or you were impregnated. Do you really want to tell officials in the criminal justice system that you make a living illegally as a prostitute?

I think the original charge on Julian Assange was something very similar - "sex by suprise" or some such thing. But that was the legal system of Sweden, which is too bizarre for sane people to understand.

One night my wife (May she rest in peace.) and I were away from home in a motel. Well the 4X Natural Lamb condom cam off. That was all we had with us, so we hoped for the best.
