Just a quick question :-)

I have a quick question that has been on my mind for awhile now. When ladies get busted in a sting, it's normally for 2 reasons...

1. Solicitation/ Crimes against nature
2. Operating without a license

Women who work for escort agencies that are registered/licensed with the Louisiana Secretary of State office...

1. Are they more, less, or as likely to get popped in a prostitution sting?
2. Are there any legitimate escort agencies here in Louisiana?

Or are ladies that work for escort agencies assuming the same risk as independent providers?

iam not a lawyer ,but just my 2 cents,even though a service has a business license,it is not for the purpose of the sex trade,so to answer you question i would say ,one is just as risky as the other.some guys might want to rent a date for a party or business matter,and have no intention of sex for money,that is what the la business license covers.They wont arrest you for no business license ,it would be for prostitution

I'm sorry that I wasn't specific in my question. What I meant was... are there any escort agencies in LA that are licensed in the state of LA, operating as "money spent for time given" -- And when I say legitimate, I mean licensed and registered with the state.

Is there an advantage in being licensed? -- IF a provider is careful in what she says to a client?

IANAL, but, as Lowgear mentioned, whichever license one has (like MT) it would be irrelevant. The charge would be prostitution.

The best thing is to just not be interesting to LE or any bystanders or passers/by who would complain about the activity.

Don't embarrass the neighbors, i.e. don't try to drum up business in the hotel lounge or waiting area.

Never involve drugs in a session-don't accept them as payment, don't offer to provide them, don't advertise yourself as "420 friendly". Don't multiply your attractiveness as a target.

Never discuss a price for an activity or list a menu of sex acts on your website. That will blow any chance you had at deniability.

Dress conservatively while traveling to outcalls and on "public" dates.

Don't partner with anyone who's not just as careful or who can't (or won't) prove she's an adult.

Don't see clients who are "important", that is people who have enemies or who would make great news stories if they get busted.

When LE sets up stings, they want to generate numbers and look important. They want to prove to property owners that they're keeping out activity that lowers property value (don't embarrass the neighbors) They want to prove that they're protecting the kids (catching drug dealers and people dealing with underage girls)

If all they can get is a single count of prostitution with no hope of getting a drug/racketeering/child exploitation informer, they've got bigger fish to fry. Most of the public's problem with prostitution seems to be with how the contact is made-the solicitation. That's actually reflected in LA's definition of prostitution: "indiscriminate sexual intercourse for pay". Some people interpret that to mean that if they discriminate for any reason, i.e. no AAs, they're safe. I don't think that's the intended meaning of "indiscriminate" here. I think that if you introduced yourselves to each other specifically to have sex for money, regardless of any other discriminatory practice, you could be prosecuted. What I think the definition protects, are people who already know each other coming to an agreement to meet each others' needs.
If one of my female friends agreed to make me happy in return for paying a car note one month, no foul. If a secretary sucks her boss' dick for a raise, she can't be prosecuted for prostitution and the legal consequences for him depend on whether he can prove that she freely offered the BJ.

The laws in the state of Louisiana are simple and to the point, Anyone found or believed to be accepting compensation for the exchange of sexual favors , as well as anyone who arranges said act by means of forwarding, connecting, or coercing, is guilty of the crime of either prostitution, inciting or pandering. Any agency that uses a general email or phone number that disables people from contacting someone directly is admitting to inciting by it's very nature. The court accepted purpose for an agency controlling calls to its employees is to guarantee the agencies income, this has been upheld in court numerous times and is the definition of inciting. If a person employed by an agency is arrested for the charge of prostitution and found guilty, the agency is by proxy guilty of pandering and inciting, as there is no clear cut way the transaction would have taken place without the direct and control of said agency.

So to answer the OP, It does not matter Indy or Agency to the provider as far as the risks of being busted, with the exception of the few occasions where providers have been changed as part of a criminal enterprise. For an agency, it tends to simply be a matter of time when it comes to a bust, as they would have no way nor claim that
1. they did not arrange the session.
2. that they did not profit from the illegal act.
3. that they did not know the act was being performed or agreed to be performed.
4. that they did not control the ability of either party to commit the crime.

Todays LE has begun to use the simple test of asking a provider and a client of the others full name. It has been accepted in court that if 2 adults have met in a neutral location and more than 300 dollars is found in the location other than a persons wallet, and that neither party has any personal information nor manner of meeting that matches , then the charge of prostitution will stick. (if he says u met at a bar and u say u met on eharmony, you are screwed)

Now the good news, there are ways to limit your chances of a bust ending in a conviction, other than the known ways, a few other things would be:

1. never have in your incall or on your person an excessive amt of cash.
2. never save texts or call history in your cell phone and DO NOT HAVE MORE THAN 1 CELL PHONE ON YOUR PERSON.(in court you WILL be found guilty of a criminal enterprise)
3. never do outcalls, as the law on a legal residence does offer some legal maneuvering.
4. never leave any sexual goods such as vibrators, lubricants, or condoms, (used or unused) in plain sight or in bulk quantities.
5. never overdress or underdress with a first time client(slinky clothing in court screams hooker).
6. never answer trick questions such as "do i need to bring my own rubbers" or "is this a bbbj or cbj" etc.
7. never be in the act of any other crimes while working, drugs are the number 1 reason for prostitution busts in the United States.
8. never draw attantion to yourself or your business in a public area, Keep your friends and pimps away from your work hotel, this is the biggest reason for busts by local authorities.
9. never say more than you need to to anyone (the right to remain silent has never hurt anyone when used)
10. Just because you are arrested, does not mean you are convicted (most convictions come from not following the advice above, people hang themselves)

I hope this is what the OP was seeking, it is my own best opinion however and i am not a lawyer or cop. The absolute best advice in this business.. Always have someone ready and waiting with either 5000 cash or bond ability, not your bf/pimp, cuz he may end up in a cell at the same time, and your agency most likely wont come to your aid as they do not want to be affiliated for fear of an Inciting charge, no matter what they say. (visit your local bondsman and make arrangements prior to accepting clients) and keep your mouth shut.
