Working and having a concealed hand gun license?

ElisabethWhispers's Avatar
I just read in another topic that if you're working, and have a concealed hand gun license, that it's illegal to do so and could escalate a prostitution charge to a felony.

In other words, not sure if I'm wording this question correctly, is it illegal for a woman working as an escort to have a license to carry a firearm in the state of Texas?

In this topic, she said that if a lady was arrested for anything other than a Class C misdemeanor for doing a crime (working girl), IF the person had this type of license, that the charge would automatically be bumped up to a felony.

Since I have been putting off for years getting mine but I was planning on doing it eventually, wanted some clarification.

Thanks,
Elisabeth
Don't have a clue, and I suspect that this may be state specific. That said, I think it would probably be more an issue of carrying the gun during the commission of a crime (prostitution) rather than just having a CHL.

A lot of criminal statutes will bump up the level of the crime if a firearm is used in the commission of the crime. I googled this and found an interesting article. Does not get to the exact point you are looking for, but it is a starting point.

Oh, and are you trying to have your own Oscar moment with that sexy right leg being exposed? (I like it, by the way.)

Someone REALLY needs to start a topic in the National Sandbox about that topic of "the leg" since they is so much discussion of it.

Thanks for the link! And the compliment.

This is probably something very important to know for those that do have guns at the incall or they carry it with them. Getting charged for prostitution would be tough. But having it be a felony charge because of not knowing the legal risks of having a handgun would be awful.

I have to question any hobby situation that requires a gun to be present. For the guy, he needs to choose more carefully. For the gal, she needs to screen more carefully.

In any event, all you need to do is have an incident occur, have the gun present, and now the DA can possibly escalate the charge. Need ShysterJon to weigh in on this one.

I knew that this question would be misconstrued. I should have probably just called an attorney.

I was just asking because I wanted to get a CHL. Period. Not to have some gun at an incall. If anyone has read what I've written for years, they would know that I do not fight and I don't have weapons at the office.

ANYTHING can be used as a weapon but I don't keep hidden knives, guns, etc. around. It's not in my nature and I'm realistic. It's the element of surprised that will get you anyway.

But I was interested in getting a gun for me, personally. But if there is a problem with having a CHL, and for whatever reason, getting in trouble with "this" ... then there is some idea that if a lady who is an escort also has a CHL, for whatever reason, that's illegal AND a felony.

That's all. Thanks for the input, though. I think that I'll ask to have this topic closed. It's going nowhere.

Elisabeth
