This is absurd & tragic. Flory & Garcia have lost their lucrative careers, been subjected to national ridicule, made to pay probably 100K in legal fees for helping Providers & guys for what is a "crime" only in the US & a few Muslim countries. And they will ultimately get off! LOL

What went wrong?
Simple. The SWC site was server located in the USA & LE simply took it over.
US subpoenas are seamless, anonymous on US internet service providers.
They are not abroad!
Flory couldn't delete stuff after he knew the site was compromised.
If he had registered & hosted the site in even Canada (where prostitution is legal, but more fuzzily vague than EU) ABQPD would never have so easily accessed all the sites "200 provider & 1200 johns" IP records.
That would have been too much hassle for a US Committee of Vice & Virtue.
Even HPD Vice couldn't invade Canada! Thank You Gina P411!

If he had located his server in Netherlands or Germany unless there was a serious crime such as sex/drug trafficking, violence, something regarded mutually as a crime- the server LE jurisdiction would have laughed at the ABQ police.

This is why Preferred411, TER, bigdoggie.net,Eros.com, all the free Escort-site.com sites have moved abroad. It protects Clients & Providers PRIVACY (not to mention the site owners, who ultimately,INEVITABLY will feel the invasive POWER of US LE, who they have generously exposed themselves to- it only takes 1 weak link in the chain-ever more probable the bigger you get).

Let's get to the essence of this- a few months ago Eccie's servers were in Canada, like P411-not best but OK. Even tho I only visit here now- I was Happy & Proud.
But Now they are back in the US, like Eraps, Horndogs, Home2.

Totally agree with the above in regards to criminal charges.

imho the gents and ladies using the SWC site will not be charged (except for the one provider who apparently led the LE into the mess).

btw, imho (I seem to say that a lot) the Feds can always pursue folks for money crimes, like laundering, avoiding taxes, etc. even if the apparent "jurisdiction" appears to be overseas.
As a follow-up for this thread: Charges have been dropped against Flory, Garcia, and Plummer. According to the Albuquerque Journal in a Nov 11th article entitled "DA to Bring Prostitution Ring Charges" the charges were dropped back in September so the detectives working the case could sort through the computer seized and all of its information. The article further says the DA expects to refile charges and present their case within a month. However the APD apparently has between 8 and 10 terabytes of info to sort through. The article mentions that at this time no further arrests are being made and they are evaluating whether to further work towards arresting and charging the "1200 johns" the site alledgly served. Evaluating as the crimes are petty misdomeanors (sp?) and could very likely not hold up in court.

Such a load of shit. No charges, and never will be. No one will ever get their day in court to clear their name.
This event will just fade into history with a trail of shattered and disrupted lives in its wake.

DA To Bring Prostitution Ring Charges

The case against former UNM President F. Chris Garcia and other suspected leaders of a large-scale online prostitution ring will likely be presented to a grand jury within a month, District Attorney Kari Brandenburg said Thursday.

But it’s not likely any of the suspected 1,000 or so “johns” who were matched with prostitutes on the underground prostitution ring named “Southwest Companions” will face charges anytime soon, say officials.

Charges against Garcia and others were dropped temporarily in September to give police more time to sort through countless data found in a computer that was seized.

Also charged were the site’s owner, David C. Flory, a 68-year-old physics professor at Fairleigh Dickinson University in New Jersey; 36-year-old Brian M. Dorsey, a former owner of the site; and 40-year-old Douglas Plummer of Albuquerque.

Garcia, who has denied any wrongdoing, is accused of recruiting new prostitutes to the online ring and protecting it from law enforcement under the alias “Burque-Pops.” He was charged with promoting prostitution, conspiracy and tampering with evidence.

The ring served more than 1,400 johns, police said.

Albuquerque police Sgt. Jason Peck said the same charges against Garcia and the other men will be refiled, but it’s not likely new charges will be brought against them.

Brandenburg, at a news conference Thursday, said she didn’t think any other people would be charged in the case.

“At this point in time, right now as we speak, we’re not looking at more individuals to prosecute,” she said.

But Peck said that’s not definite because detectives still have between 8 and 10 terabytes of information to sort through.

Peck said two detectives and up to 10 department employees will start reviewing the computer data next week.

“We might find a smoking gun, where we might go after everybody,” Peck said.

But even if authorities decided to charge the johns who used Southwest Companions, prosecuting them would be challenging because it could be difficult to prove they met and hired a prostitute as opposed to just soliciting them online, Peck said.

He said it would be likely for a suspect to say they were just pretending or playing online, without ever going through with the exchange.

“The question is, are we going to dedicate hundreds and hundreds of manpower (hours) to petty misdemeanors that there is a good chance we’re not gonna be able to prove?” Peck said. — This article appeared on page C1 of the Albuquerque Journal
