I too saw this and immediately thought of ECCIE. It sounds as though the guy was doing a bit more than just running a BB though. I'm sure if they wanted to though, they could trump up charges on anybody.

Read the 2nd to last paragraph. He cut a deal so they would lighten up on what they could have convicted him on.
