The idea that this will infringe on patent rights is a stretch.
They just did not want you to refill their ink cartridges and resell them at a much cheaper price.
It is not like this will allow companies to build products that are patented without paying a licensing fee.
Compounding pharmacies have been taking prescription medicine and reselling in a different form for years. They do not manufacture patented drugs, they just reform them.

Let's say a company will only sell you a widget that is patented and the only way to buy it is three to a box.
So you buy one and sell the other two at more than the individual cost but less than the cost for three.
The big key will be software. From what I understand you can resell software but have to remove it completely from your system before you can pass it along.

It is the free market at work. If Lexmark et al charged a reasonable price for ink, refillers would not have entered the market. Perfect example of how the free market works to control cost to consumers.

they also short change you on the amount of ink that is left in the cartridges. there is a sensor on the cartridge that tells the printer how much ink is left.

It tells the printer that the cartridge ran out of ink when in fact it has quite a bit more ink left. don't know the ratio, it is somewhere between 30 - 40 % left of ink. It dupes the consumer in buying more ink when they don't need to.

the re-sellers are part of that solution, they will sell you a full ink of cartridge.

they do have some methods to "reboot" the cartridge so you can use the remaining ink that is left, but they are not that very reliable.
